Terms of Service

01Partner Accounts

To use most features of the Platform, you must register as a Partner and provide accurate, complete information about yourself and your agency. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account, including actions taken by your agents
• Notifying us promptly of any unauthorized use of your account
• Ensuring the information you and your agents submit for bookings is accurate

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

02Plans, Billing & Free Trial

The Platform is offered under monthly and annual subscription plans, billed in advance through our payment processors (Stripe, Razorpay, or PayPal, depending on your region). A free trial period may be offered to new Partners; at the end of the trial, your selected paid plan will begin unless you cancel beforehand.

• Subscription fees are billed automatically at the start of each billing cycle
• Prices may change with reasonable advance notice; continued use after a price change constitutes acceptance
• Fees are generally non-refundable except where required by law or expressly stated otherwise
• You are responsible for any taxes applicable to your subscription based on your jurisdiction

03White-Label Use & Branding

Depending on your plan, you may configure your booking website with your own branding, logo, and domain. You are solely responsible for the accuracy of content, pricing markups, and representations made on your branded site to your customers. DIY Travel is not a party to the contract of carriage or accommodation between you (or your customers) and the airline or hotel; our role is to provide the technology connecting your site to GDS and hotel inventory.

04Bookings & GDS Reliance

Flight and hotel availability, pricing, and rules displayed through the Platform are sourced in real time from connected GDS systems (Amadeus, Sabre, Galileo) and hotel/channel inventory. We do not guarantee the accuracy, availability, or continued validity of any fare, fee, or rate at the moment of booking, as these are controlled by third-party suppliers and subject to change without notice.

05Acceptable Use

You agree not to:

• Use the Platform for any unlawful, fraudulent, or deceptive purpose
• Attempt to reverse-engineer, scrape, or interfere with the Platform's underlying systems or GDS connections
• Circumvent usage limits, rate limits, or security controls
• Resell or sublicense access to the Platform outside of your agreed plan and permitted white-label use
• Upload or transmit malicious code, or use the Platform to harm any third party
• Misrepresent your identity, agency accreditation, or GDS/IATA credentials

We may suspend or terminate access immediately for violations of this section.

06Intellectual Property

The Platform, including its underlying software, design, and documentation, is owned by DIY Travel and protected by applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Platform to operate your booking website during your active subscription. You retain ownership of your own brand assets, content, and customer data that you upload or generate through the Platform.

07Cancellation & Termination

You may cancel your subscription at any time from your dashboard under Settings → Billing. Cancellation takes effect at the end of your current billing period, and you retain access until that date. We may suspend or terminate your account, with or without notice, if:

• You violate these Terms or our Acceptable Use policy
• Payment for your subscription fails or remains overdue
• We are required to do so by law, or by a GDS/supplier partner's own terms

08Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that GDS/supplier data displayed will always be accurate or current.

09Limitation of Liability

To the fullest extent permitted by law, DIY Travel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of or inability to use the Platform, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you paid us in subscription fees during the three (3) months preceding the claim.

10Indemnification

You agree to indemnify and hold DIY Travel harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party, including your customers or their bookings.

11Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts, unless otherwise required by mandatory local consumer protection law applicable to you.

12Changes to These Terms

We may revise these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date, and where appropriate, communicated to active Partners via email. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
